William F. Clark
Will Clark was born and raised in Fayetteville, Arkansas. He graduated from Vanderbilt University in 2007 with a Bachelor of Arts in Political Science, Cum Laude, and received his Juris Doctorate from the University of Arkansas School of Law, Magna Cum Laude, in 2010. While in law school, Will was named the Joe C. Barrett Commercial Transactions Scholar, he was a member of the Board of Advocates, and he served as an Associate Editor for the Arkansas Law Review where his case note, Blazing a New Trail: The Effect of Medical Liability Mutual Insurance Co. v. Alan Curtis on the “American Rule” and an Insurer’s Right to Attorneys’ Fees, was published in 2009.
As a partner in the firm, Will primarily focuses his practice in the areas of civil litigation, to include commercial litigation, general insurance defense and contract litigation. Will also represents individuals and businesses in a variety of other matters, including real estate transactions and disputes, negotiating and litigating non-competition agreements, bankruptcy and creditor rights, and he advises and counsels clients in litigation avoidance strategies. Will also serves as local counsel to out-of-state attorneys and litigants involved in ongoing Arkansas litigation. Will has been selected by Best Lawyers in America in the areas of Commercial Litigation, Insurance Law and Litigation – Real Estate, he has been named a Fellow with Litigation Counsel of America, and he is rated AV-Preeminent by Martindale-Hubbell.
In addition to his practice, Will is also actively involved in the Northwest Arkansas community, serving on the Board of Directors for Butterfield Trail Village and having previously served on the Fund Development Committee for the Washington County Children’s Safety Center, as a Diplomat for the Fayetteville Chamber of Commerce and on the Vestry of St. Paul’s Episcopal Church. Some of Will’s more recent experience includes:
- Obtaining summary judgment on behalf of insurance company in three separate first party claims for Underinsured Motorist Benefits arising out of a catastrophic motor vehicle accident, affirmed on appeal;
- Obtaining verdict in favor of client after jury trial on Complaint alleging negligence and seeking damages for permanent injuries;
- Obtaining summary judgment on behalf of insurance company in a direct action filed by national transportation and logistics company in United States District Court;
- Obtaining dismissal of Complaint, and monetary judgment on Counterclaim, in favor of client after trial over commercial property dispute;
- Obtaining summary judgment on behalf of a mental health paraprofessional in United States District Court for claims filed under 42 U.S.C. 1983;
- Obtaining summary judgment and dismissal of general contractor’s Complaint on behalf of an electrical subcontractor in a multi-million dollar construction defect litigation;
- Obtaining a favorable settlement on behalf of a child care facility in civil litigation involving allegations of child neglect and abuse;
- Obtaining favorable settlement on behalf of judgment creditor in an action to set aside fraudulent conveyances of personal and business assets;
- Litigating family dispute over extensive business estate assets and securing favorable resolution on behalf of the administrator of decedent’s estate;
- Successfully defending and obtaining dismissal of a legal malpractice lawsuit in United States District Court. Dismissal was affirmed by Eighth Circuit Court of Appeals;
- Successfully representing multiple residential and commercial property owners in eviction proceedings against tenants;
- Successfully arguing an interlocutory appeal before the United States Court of Appeals for the Eighth Circuit on behalf of a prisoner in 42 U.S.C. 1983 civil rights litigation;
- Obtaining favorable settlement on behalf of local hotel in premises liability lawsuit.
